Alaska DePuy Hip Implant Lawsuits

DePuy Orthopaedics has issued a recall of two of its hip implants because of a loosening of the device which leads to a high failure rate. What is a Statute of Limitations?

Each state, including Alaska, sets a limit on the amount of time people affected by personal injury, wrongful death, or defective products have to file a lawsuit. When this limit expires, the person or company responsible for the injury no longer has any accountability for their negligence.

The time limit can either begin to run from when the injury occurred, known as the occurrence rule, or from when the injury was discovered, known as the discovery rule. In Alaska, lawsuits must be filed within 2 years in personal injury and wrongful death, and also 2 years for defective products, but the defective products cases use the discovery rule.

DePuy Implant Failures

The DePuy hip implants which have been recalled, the ASR™ XL Acetabular System and the ASR™ Hip Resurfacing System, have both been failing within 5 years of implantation in some patients. A properly functioning hip implant is supposed to last at least 15 years.

Patients whose hips have failed need to undergo a costly and painful second surgery known as a revision surgery. DePuy has volunteered to reimburse the costs of these second surgeries, but has offered nothing for the pain, suffering, lost wages, and time lost to this second surgery.
