Arizona DePuy Hip Implant Lawsuits

Two hip implant systems manufactured by DePuy Orthopaedics have been recalled due to high failure rate and side effects which can cause serious complications. If you were a recipient of a DePuy hip implant and have experienced pain and suffering, you are eligible to file a lawsuit to recover compensation.

However, in cases involving defective products, there is a limit to the amount of time you can take before deciding to file a lawsuit, known as the statute of limitations. There may be no time to waste in your own case, so contact a DePuy lawyer as soon as possible.

Arizona Statute of Limitations

The statute of limitations for personal injury, wrongful death, and defective products cases in Arizona is 2 years. The clock starts ticking based on what is known as the discovery rule, meaning the statute of limitations starts when the injured party discovers the problem or injury.

Even if the injured party didn't discover the problem, if it is determined that a reasonable person would have, the discovery rule will start from that point. When the statute of limitations has been reached, you will be unable to file a lawsuit regardless of the extent of your injuries.

Hip Implant Failure

DePuy hip implants have been failing at an alarming rate of 5 years after being implanted. This has been caused by a loosening of the implant, leading to severe pain and swelling near the hip, and problems walking and standing. There have also been problems with the metal on metal joint of the implants, which can cause metal shavings to break free and poison the recipient. In either case the defective implant requires a second surgery known as a revision surgery, which is both costly and painful.

The two models which have been recalled are the:

  • ASR™ XL Acetabular System
  • ASR™ Hip Resurfacing System

The Acetabular system is a total hip replacement, while the resurfacing system tries to keep as much of the original bone as possible. DePuy has offered to pay for the revision surgery for anyone who has received these implants, but this offer doesn't include any compensation for the pain and suffering the defective implants have caused.
