Arkansas DePuy Hip Implant Lawyers

Arkansas residents who have received hip implants made by DePuy Orthopaedics have been implanted with defective and potentially dangerous products. In order to recover compensation for the injuries these defective products have caused or may cause, you must file a DePuy lawsuit before the statute of limitations has expired.

Contact an Arkansas hip implant lawyer today for more information.

What is the Statute of Limitations?

In every state there is a limit to the amount of time someone can wait before filing any kind of lawsuit, including those involving a personal injury, wrongful death or defective products. Depending on the type of case, the clock begins ticking either from the time the injury or incident occurred, which is known as the occurrence rule, or from the time the injury was discovered, which is known as the discovery rule.

With the discovery rule the limit begins when a reasonable person should have discovered the problem, which may be before it was actually discovered.

In Arkansas the statute of limitations is as follows:

  • Personal Injury - 3 years, with the discovery rule
  • Defective Products - 3 years, with the discovery rule
  • Wrongful death - 3 years

If you fail to file a lawsuit before these time limits are reached, your lawsuit will not be allowed.

DePuy Hip Implant Failures

The implants which have been recalled by DePuy are the ASR™ XL Acetabular System, which is for total hip replacement, and the ASR™ Hip Resurfacing System. Both were recalled due to a high failure rate, with the failures occurring in as few as 5 years of the original surgery.

As part of the recall, the manufacturer has offered to pay for the costs of the revision surgery which a failed implant requires. However, this offer doesn't include any compensation for the disruption to your life, or the pain and suffering that a failed implant can cause.
