California DePuy Hip Implant Lawsuits

What is the Statute of Limitations?

The statute of limitations is the amount of time set by each state as the maximum allowed before a lawsuit must be filed. The time limit can either begin when the incident or injury occurs, or from the injury is discovered, which is known as the discovery rule.

In California the statute of limitations is as follows:

  • Personal Injury - 2 years, with the discovery rule
  • Product liability - 2 years, with the discovery rule
  • Wrongful death - 1 year

DePuy Implant Failures

The hip implant systems that have been recalled are the ASR™ XL Acetabular System, which is for total hip replacements and the ASR™ Hip Resurfacing System. Each has a high likelihood of failure within 5 years of initial surgery, while a properly functioning hip implant should last at least 15 years. Patients have experienced problems with the implant loosening, which has caused:

  • Severe pain
  • Swelling in the area of the implant
  • Trouble walking and standing
  • Eventually causes a total failure of the implant

In addition, the metal on metal joint of the DePuy hip implant can cause microscopic shavings generated by friction to break off and enter the bloodstream. These shavings can lead to soft tissue damage, inflammation, and metal poisoning. In either case the implant needs to be replaced, during a second surgery known as a revision.

DePuy has offered to pay for the necessary revision surgeries, but this does not include compensation for the disruption to your life or your pain and suffering.
