Colorado DePuy Hip Implant Lawsuits

Two models of hip implants manufactured by DePuy Orthopaedics have been failing at such an alarming rate that they have been recalled. Patients who have had these systems implanted are at risk of needing revision surgery, which can be as costly and even more painful as the first hip surgery.

If you or a loved one has been injured by one of these defective implants, it is important to contact one of our attorneys as soon as possible in order to protect your rights. There is a statute of limitations which will prevent you from filing a lawsuit if you wait too long. Each state has its own limitations.

Colorado Statute of Limitations

The statute of limitations is an amount of time set by law which limits how long an aggrieved party can wait before filing a lawsuit. While each state has a statute of limitations, the actual amount of time will vary. In Colorado the limit is 2 years in personal injury cases, wrongful death cases and product liability cases. In Colorado the clock starts ticking based on the discovery rule, meaning the 2 years begins from the date that the injury or defect was discovered.

DePuy Implant Failures

The two recalled systems are the ASR™ XL Acetabular System, which has failed 13 percent of the time, and the ASR™ Hip Resurfacing System, which has failed 12 percent of the time, according to the recalls. Most of the problems with these implants are due to the acetabular cup, which is the socket portion of the ball and socket joint. Many surgeons have complained that the part is too shallow to properly hold the ball portion of the implant and becomes loose.

Signs that your implant may be defective and failing include:

  • Swelling and pain in the groin, lower back and hip
  • Problems rising from a seated position
  • The sensation that the hip is out of place
  • Problems walking
  • Popping or grinding noises coming from the implant
