Delaware DePuy Hip Implant Lawsuits

Two types of hip implants manufactured by DePuy Orthopaedics have been recalled due to a high failure rate. Delaware Statute of Limitations

The statute of limitations is the maximum amount of time allowed by law during which people are allowed to file a lawsuit. It can vary from state to state, and will be based on the discovery rule or the occurrence rule. The discovery rule means the limitation starts from the day the injury or defect is discovered, rather than when it actually occurred. In Delaware the amount of time for personal injury, wrongful death, and products liability cases is 2 years, using the discovery rule.

Failed DePuy Implants

The two recalled systems are the ASR™ XL Acetabular System, which is a total replacement implant that has failed 13 percent of the time, and the ASR™ Hip Resurfacing System, which has failed 12 percent of the time, according to the recall.

Problems with the ASR™ XL Acetabular System implants involve a loosening of the acetabular cup, which is the socket portion of the ball and socket joint. Surgeons have complained that the cup is too shallow to properly hold the ball portion of the implant.

Signs that your implant may be defective and failing include:

  • Swelling and pain in vicinity of the implant
  • Problems rising from a seated position
  • Problems walking or standing
  • Crunching or grinding noises coming from the area of the implant
  • The feeling that the hip is out of place
