Florida DePuy Hip Implant Lawsuits

Patients who have received artificial hips manufactured by DePuy Orthopaedics have been implanted with defective products. The hip implants have a high failure rate and can also cause serious side effects which can lead to serious health problems.

If you've undergone a second hip surgery because you were given a defective implant, you can seek compensation from DePuy through a lawsuit. However, you must file your lawsuit before the statute of limitations expires, so contact one of our attorneys immediately.

Florida Statute of Limitations

The statute of limitations is the maximum amount of time the law allows someone to wait before filing a lawsuit against the party which has caused their injury. Each state has its own limitations. The state of Florida follows the discovery rule, which means the time starts when an injury is discovered. So, from the date that an injury is discovered, a persona has the following amount of time to file a lawsuit in Florida:

  • Personal injury - 4 years from the discovery of the injury
  • Wrongful death - 2 years from the date of death
  • Product liability - 4 years with the discovery rule

DePuy Hip Implant Failures

The defective hip implants that are involved in the recall include the:

  • ASR™ XL Acetabular System
  • ASR™ Hip Resurfacing System

According to the recall each has an approximate 12-13 percent chance of failing within the first 5 years, while a properly functioning hip implant should last at least 15 years. Other studies suggest a higher percentage.

Most of the problems stem from a loosening of the cup which forms the socket portion of the ball and socket joint. Loose implants cause pain, swelling and problems with walking and standing.

These implants can also cause problems for the recipients because the metal on metal area in the joint of the implant can generate metal shavings. These shavings escape into the bloodstream and can lead to inflammation and soft tissue damage, and also put the body at risk of metal poisoning. Metal poisoning can cause organ failure and neurological problems.
