Georgia DePuy Hip Implant Lawsuits

Patients who have been implanted with artificial hips manufactured by DePuy Orthopaedics have received a defective product which can require surgeries to correct, and put patients at risk of serious health conditions. These hip implants have been recalled by the manufacturer because of a high failure rate.

If you have been affected by a defective hip implant, you have the right to seek compensation through a lawsuit. Like all other states, Georgia has a statute of limitations, so contact one of our Georgia hip implant lawyers today.

What is the Statute of Limitations?

The statute of limitations is the time limit set by the state which governs how long an injured person can wait before filing a lawsuit. Lawsuits that are filed after this period of time expires will be thrown out. The following are the time limits which are set by the state of Georgia:

  • Personal Injury - 2 years from the discovery of the injury
  • Wrongful Death - 2 years from the time of death
  • Product Liability - 2 years from the point of discovery, or 1 year from the time of death

DePuy Hip Implant Failures

The DePuy hip implants have two major problems that require a second surgery known as a revision surgery. The first, which is the manufacturers stated reason for the recall, is the high failure rate due to a loosening of the acetabular cup. That is the socket part of the ball and socket joint, which many surgeons have complained is too shallow to properly hold the ball portion of the joint.

A loose implant can result in:

  • Severe pain and swelling in the vicinity of the replaced hip
  • Trouble walking and standing
  • Bone fractures and dislocation

The DePuy implants also have areas where metal on metal friction generates microscopic shavings which can get loose in the body. These can cause inflammation and damage surrounding tissues, and can also poison the blood. The metal debris can damage the liver and kidneys, and cause nerve and brain damage.

Patients who aren't suffering pain may still be at risk.
