Hawaii DePuy Hip Replacement Lawsuits

Hip replacement patients who received artificial hips manufactured by DePuy Orthopaedics are at risk of implant failure. If you have a defective artificial hip need a revision surgery, or if you've already undergone surgery to fix your faulty implant, you can seek compensation through a DePuy lawsuit.

It is important to consult an attorney in your area as quickly as possible, because there are time restrictions as to when you can file a lawsuit. Contact a Hawaiian hip implant attorney today for more information.

What is the Statute of Limitations?

The statute of limitations is the amount of time states allow someone to wait before they file a lawsuit against someone who has wronged them. If you attempt to file a lawsuit after the time limit has expired, the lawsuit can be thrown out.

The Hawaii statute of limitations is:

  • Personal Injury - 2 years, with discovery rule
  • Wrongful Death - 2 years from date of death
  • Product Liability - 2 years, with discovery rule

DePuy Hip Replacement Failures

The two hip replacement systems which have been recalled are the DePuy ASR™ XL Acetabular System, which is for total hip replacement, and the ASR™ Hip Resurfacing System. According to the recall, both implants have a high failure rate. Patients have experienced hip implant failures in as few as 5 years after implantation; a properly functioning implant is supposed to last at least 15 years.

Symptoms of a defective hip implant include:

  • Recurring pain in the hip, leg, or lower back
  • Audible clicking or grinding noises coming from the replaced hip
  • Swelling in the hip
  • Decrease in flexibility, reduced range of motion
  • Difficulty walking or standing
  • Fractures and dislocation

DePuy has offered to pay for the required revision surgeries, but has not offered anything for the disruption to the lives of their patients, or for their pain and suffering. Our attorneys are dedicated to helping affected patients get compensation not only to pay for revision surgery, but also to pay for the pain and suffering associated with the failed device.
