Idaho DePuy Hip Implant Lawsuits

DePuy Orthopaedics has manufactured two artificial hip systems which have high failure rates and have been recalled. The recipients of these defective devices need a revision surgery, which is costly and painful. If you have a failed hip implant made by DePuy, you have the right to seek compensation for your injuries. Lawsuits against DePuy must be filed before the statute of limitations expires, so contact an Idaho hip implant lawyer today.

Idaho Statute of Limitations

The statute of limitations is the maximum allowable time someone can wait before filing a lawsuit. The time limits set by Idaho are as follows:

  • Personal Injury - 3 years from the date of the occurrence
  • Wrongful Death - 2 years from the date of death
  • Product Liability - 2 years from the date of occurrence

DePuy Hip Implant Failures

The two hip implant systems which have been recalled are the ASR™ XL Acetabular System, which is for total hip replacement, and the ASR™ Hip Resurfacing System. At the time of the recall, the Johnson & Johnson company claimed that the total hip replacement system was failing at a rate of 13 percent in the first 5 years, and the resurfacing system was failing at a rate of 12 percent in the first 5 years.

This seems high. But, according to a British orthopedists' group, the failure rate is actually four times what the company claims. According to The British Orthopedic Association and the British Hip Society, the failure rate of the ASR™ XL Acetabular System ranges from 21 percent after 4 years to 49 percent after 6 years. A properly functioning implant is supposed to last 15 years.

The problem with the implant systems start with the cup which forms the socket of the ball and socket joint in the hip. Many surgeons have complained that the cup is too shallow to properly hold the ball part of the joint. Over time the implant loosens, which can cause severe pain and swelling in the area of the implant, and leads to trouble walking and standing. Other complications can include dislocations and bone fractures.

Contact an Idaho Hip Implant Attorney

If you or a loved one has been injured by a failed DePuy hip implant, you should protect your rights by contacting one of our attorneys immediately. DePuy has offered to pay for the cost of the revision surgery, but has offered nothing for the disruption to people's lives, or the pain and suffering of the victim.

Our hip implant attorneys believe that the company should be held accountable for their faulty devices and should compensate patients for their pain and suffering as well as their lost wages and medical bills. To schedule a free review of your case, contact us today.
