Two models of hip implants made by DePuy Orthopaedics have been recalled due to high failure rates. What is the Statute of Limitations?

A statute of limitations is a specified amount of time during which people are eligible to file lawsuits against someone who has wronged them. The time limit in each state differs, and there are different criteria which determine when the clock starts to run. It can either be from when the injury occurs (occurrence rule) or when the injury is discovered or should have been discovered (discovery rule).

The following are the time limits established in Illinois:

  • Products Liability - 2 Years (2 year discovery rule applies if the injury occurred within 10-12 year period)
  • Wrongful Death - 2 Years ( from date of death)
  • Personal Injury - 2 Years, with Modified Discovery Rule (2 years from the time the plaintiff knew or should have known about the injury, even if plaintiff did not know it was actionable)

DePuy Implant Lawsuits

DePuy, a division of Johnson & Johnson, said the reason for the recall is that the implants are failing at a very high rate. While most hip implants are expected to last a minimum of 15 years, the recalled DePuy hips are failing in as few as 5. When an implant fails, the patient will need a second surgery to fix the problem. Revision surgery is often more painful and debilitating than the initial surgery.
