Indiana DePuy Hip Implant Lawsuits

Recipients of DePuy hip replacement systems are at risk of needing revision surgery if their hip implants fail. According to DePuy, the implants have been failing at a high rate, between 12 and 13 percent. But, according to a British orthopedists' group, the failure rate is actually four times what the company claims. The group says the hips are failing at a rate between 21 and 49 percent.

If your implant fails, requiring you to undergo a second painful surgery, our Indiana hip implant lawyers can help you seek compensatory damages. It is important to contact us as soon as possible, however, because the state has set limitations on the amount of time you have to file a lawsuit.

Indiana Statute of Limitations

The statute of limitations is the amount of time set by individual states to regulate how long people have to file lawsuits. If the lawsuit is not filed before the statute of limitations expires the lawsuit will be thrown out.

The following is the statute of limitations for the state of Indiana:

  • Personal Injury - 2 years from discovery of the injury
  • Wrongful Death - 2 years from date of death
  • Products Liability - 2 years from the discovery of a product defect

DePuy Hip Implant Failures

The DePuy implants which have been recalled are the ASR™ XL Acetabular System, which is for total hip replacement, and the ASR™ Hip Resurfacing System. The ASR™ Hip Resurfacing System was never approved in the U.S.

Complications that arise from the defective implants include:

  • Pain and swelling in the hip
  • Problems standing and walking
  • Hip dislocation
  • Bone fractures

Patients are also at risk of suffering metal poisoning because of the metal-on-metal design of the implants. As the metal components rub on each other, small metal particles can shed off into the bloodstream. This puts patients at risk of suffering metal poisoning, inflammation in the surrounding tissue and organ damage.
