The 2010 DePuy Hip Implant Recall

  • misalignment and loosening of the components of the implants
  • dislocation of implant components
  • patient/recipient infections, bone fractures, and pain

DePuy is also accused of failing to test the hip implants adequately before releasing them on the market, and of failing to warn surgeons, physicians and patients of the design problems as soon as DePuy knew of them.

Legal Actions regarding DePuy Hip Implants

The DePuy ASR™ XL Acetabular System has been implanted in U.S. patients since July 2003. The ASR™ Hip Resurfacing System was not approved for use in the U.S.; it's used elsewhere. Tens of thousands of patients have received one of these two models of hip implants, and now it's apparent that the complication and failure rate (estimated at about 13 percent) is far higher than the normal, accepted failure rate, which is 5 percent.

Over 3,500 lawsuits have been filed against DePuy Orthopedics based on these hip implant failures. Multidistrict litigation (like a class action) has commenced in the Eastern District of Texas to handle all the hip implant lawsuits against DePuy, and DePuy has already offered to pay for many patients' revision surgery (the surgical attempt to replace a defective hip implant).
