New York DePuy Hip Implant Lawsuits

If you are the recipient of an artificial hip manufactured by DePuy Orthopaedics, you might be at risk of failure. DePuy recalled two models of hip implants due to high failure rates which require painful and costly revision surgeries. If your hip has failed, or you are experiencing symptoms of failure, contact a New York hip implant lawyer. You may still be eligible to file a lawsuit before the statute of limitations expires.

New York Statute of Limitations

The statute of limitations is the amount of time set by the state which regulates how long you have to file a lawsuit following an injury. Lawsuits can't be filed after this time limit expires. Each state is responsible for setting its own statute of limitations. In New York the statute of limitations is as follows:

  • Personal Injury - 3 Years
  • Wrongful Death - 2 Years
  • Products Liability - 3 Years

DePuy Hip Implant Failures

There are two models of DePuy hip implants that have been recalled due to defects:

  • ASR™ XL Acetabular System
  • ASR™ Hip Resurfacing System

The Acetabular System is a total hip replacement system, while the Resurfacing System is meant to preserve as much of the original hip as possible. The total hip replacement system has been failing at a rate of 13 percent and the resurfacing system fails at a rate of 12 percent in as few as 5 years of surgery, according to DePuy. A properly functioning implant is expected to last at least 15 years.

After the recall, a British orthopedists' group came forward and said that the implants were failing at an even higher rate. According to The British Orthopedic Association and the British Hip Society, failure of the systems range from 21 percent after 4 years to 49 percent after 6 years of implantation.

Why the Systems are Failing

Many surgeons have complained that the acetabular cup portion of the implant is too shallow to properly hold the femur in place. The cup is the socket portion of the ball and socket joint which makes up the hip. When the implant becomes loose it can cause severe pain and swelling in the region of the hip, including the lower back and the groin. It will also cause problems with the normal stride, and may cause popping or grinding noises while walking.

Some patients have alleged dislocations and fractures of the hip.

DePuy has offered to pay for the cost of the hip revision surgery, but has offered nothing for the pain and suffering that the implants have caused. Revision surgery is often more debilitating than the initial surgery and can result in severe pain.

A lawyer for defective hip implants can help you get the compensation you deserve. Call today and speak with a New York DePuy hip implant lawyer.
