North Dakota DePuy Hip Implant Lawsuits

DePuy Orthopaedics recalled two of its hip implants due to design flaws that can cause complications and failures. When an implant fails it requires a costly and painful second surgery known as a revision surgery. If you received a defective hip and had to undergo revision surgery, you should contact a North Dakota hip implant attorney for help. You may still be eligible for compensation for your injuries before the statute of limitations expires.

What is the Statute of Limitations?

The statute of limitations is the maximum amount of time you can wait to file a lawsuit. The clock starts ticking either from the time of the injury, which is known as the occurrence rule, or from the day the injury is discovered, which is known as the discovery rule.

The statute of limitations for North Dakota is as follows:

  • Personal Injury - 2 years, with the discovery rule
  • Wrongful Death - 2 years from the date of death
  • Products Liability - 10 years after the date of initial purchase for use, or 11 years from the date of manufacture

DePuy Implant Failures

The DePuy implants that have been recalled are the ASR™ XL Acetabular System and the ASR™ Hip Resurfacing System. According to DePuy, they both fail at a rate of 12-13 percent within the first 5 years following the initial implantation. A properly functioning implant is expected to last at least 15 years. The implants fail because they become loose due to the socket portion of the joint being too shallow.

When the implant becomes loose it will cause pain and swelling in the joint. The recipient will have trouble walking and standing, and the implant may make popping or grinding noises while in movement. Surgery is the only treatment method for a failed implant.

The metal on metal components of the joint may also generate tiny shreds of metal as they rub against each other. The metal debris can get loose in the body and cause health complications such as tissue damage and blood poisoning.
