Oregon DePuy Hip Implant Lawsuits

Recipients of artificial hips manufactured by DePuy Orthopaedics are at risk of early failures. The company recalled two of its hip implants due to design flaws and high failure rates. Oregon Statute of Limitations

The statute of limitations is the maximum amount of time you can wait to file a lawsuit after suffering a loss or being injured. The rules vary from state to state. In Oregon they are as follows:

  • Products Liability - 2 years, with the discovery rule. The discovery rule is one of the criteria which is used to determine when the time begins. Using the discovery rule, the statute of limitations doesn't begin running until the injury is discovered, or from when the injury should have been discovered by a reasonable person.
  • Personal Injury - 2 years, with discovery rule.
  • Wrongful Death - 3 years with the occurrence rule. The occurrence rule is the opposite of the discovery rule, meaning that the clock starts at the time of the injury, not at the time of discovery.

DePuy Implant Failures

The recalled implants include the ASR™ XL Acetabular System and ASR™ Hip Resurfacing System. At the time of the recall, DePuy claimed that the implants were failing at a rate between 12 and 13 percent after only 5 years. Most implants are expected to last at least 15 years. Some groups believe the implants are failing at an even higher rate.

Problems involve loosening of the implant from the bone that can result in dislocations and bone fractures. Also, surgeons have complained that the cup is too shallow to properly hold the femur portion in place.

Signs that your implant may be defective and failing include:

  • Swelling and pain in the vicinity of the hip, groin and lower back
  • Problems rising from a seated position
  • Problems walking or standing
  • Crunching or popping noises coming from the implant
