Rhode Island DePuy Hip Implant Lawsuits

Two types of DePuy hip implants were recalled due to high failure rates that require a second hip surgery called a revision surgery. The victims of these defective products have legal options, which can include a lawsuit against the manufacturer. If your implant has failed, or is showing signs of the defect, you should contact a Rhode Island hip implant lawyer as soon as possible. Any actions against DePuy must be started before the statute of limitations expires.

Rhode Island Statute of Limitations

The statute of limitations is the limit that individual states set to control how long you have to file a lawsuit. Lawsuits are not allowed after the statute of limitations is up. Individual states also set the criteria for when the clock starts ticking on the statute of limitations. Rhode Island uses the discovery rule as the start of the time limit, meaning the statute of limitations begins when the injury is discovered, rather than when it occurs.

In Rhode Island the statute of limitations is as follows:

  • Personal Injury - 3 years, with the discovery rule
  • Products Liability - 3 years, with the discovery rule
  • Wrongful Death - 3 years from the injury or death

DePuy Hip Implant Failures

The DePuy hip implants which have been recalled are the ASR™ XL Acetabular System and the ASR™ Hip Resurfacing System. The recall is based on the fact that some implants are failing in as few as 5 years. Properly functioning implants are expected to last at least 15 years. Damage to the area around the hip caused by the original implant often makes the revision more difficult and painful than the first hip surgery.

According to reports, the full hip replacement systems have a design flaw related to the cup which forms the socket of the ball and socket joint. Many surgeons have complained that the cup is too shallow. Loose implants can cause the following symptoms:

  • Pain deep in the groin, hip, and lower back
  • Swelling around the implant
  • Difficulty rising from a seated position and walking
  • Popping or grinding sounds when walking

You should contact your doctor if you start experiencing these signs and symptoms.
