Tennessee DePuy Hip Implant Lawsuits

DePuy Orthopaedics recalled two models of hip implants which have already been implanted in approximately 93,000 people. These implants are failing at an alarming rate and require a painful and costly revision surgery. If you are the victim of one of these defective products, contact a Tennessee hip implant attorney. You may be eligible to file a lawsuit against the manufacturer if the statute of limitations has yet to expire.

What is the Statute of Limitations?

The statute of limitations is the maximum amount of time allowed by law for a plaintiff to file a lawsuit after an injury or otherwise damaging incident. Lawsuits which are attempted after this time limit has expired will generally be thrown out. The time limit can begin in one of two ways, either when the injury occurs (occurrence rule) or when the injury is discovered (discovery rule).

Each state has different requirements, so it is important that you speak with an attorney that is familiar with the requirements in your state.

Tennessee Statute of Limitations

The following is the statute of limitations for relevant types of cases in Tennessee

  • Personal Injury - 1 Year, with the discovery rule
  • Wrongful Death - 1 Year, with the discovery rule
  • Products Liability - 1 Year, with the discovery rule

DePuy Hip Implant Failures

The two recalled products are the ASR™ XL Acetabular System and the ASR™ Hip Resurfacing System. The reason behind the recall is that the implants have been failing at a rate of 12-13 percent, according to the Johnson & Johnson company. Many surgeons believe that the socket portion of the joint, called the acetabular cup, is too shallow to support the joint. The implants become loose, which can lead to problems with walking or standing, and cause severe pain and swelling in the hip, groin, and lower back.

In addition, the metal on metal joint can generate metal debris caused by friction. These microscopic shavings cause inflammation, soft tissue damage and enter the bloodstream. Eventually the debris can lead to metal poisoning, which can cause organ failure, nerve damage and brain damage. The FDA is evaluating the risks of all metal-on-metal hip implants to determine what the risks are.
