Utah DePuy Hip Implant Lawsuits

DePuy Orthopaedics announced that it was recalling two hip implant systems due to complications and high failure rates. When the artificial hip implants fail, they require that the patient receives a second surgery. Revision surgery can be more difficult and painful than the first hip surgery.

If you or a loved one was implanted with a faulty DePuy hip implant, you have legal options, and should contact a Utah hip implant attorney. It is important to protect your rights before the statute of limitations on your potential claim expires.

Utah Statute of Limitations

The statute of limitations is a state law that restricts the time in which legal proceedings may be brought by a plaintiff. Lawsuits are not allowed after this time limit expires. States establish different deadlines depending on whether the case involves a contract, personal injury, wrongful death, etc. In Utah the time limits or relevant cases are as follows:

  • Personal Injury - 2 years, with the discovery rule (the discovery rule means that the time limit begins when the injury is discovered, rather than when it actually occurs)
  • Wrongful Death - 2 years, years with the discovery rule
  • Products Liability - 2 years, with the discovery rule

DePuy Hip Implant Failures

The two devices that are named in the DePuy hip implant recall are the ASR™ XL Acetabular System and the ASR™ Hip Resurfacing System. According to DePuy, the implants have a failure rate of 12 and 13 percent within 5 years of surgery. Some patients have reported that their implants have failed in as few as 2-3 years. According to industry standards, hip implants should last at least 15 years.

Signs that a hip implant might be failing include:

  • Swelling in the hip area
  • Severe pain
  • Difficulty standing from a sitting position
  • Difficulty walking
