Virginia DePuy Hip Implant Lawsuits

The medical device manufacturer DePuy Orthopaedics recalled two of its hip implant systems in August 2010 due to high failure rates. Before the hip implants were recalled, more than 93,000 people were implanted with one of the devices.

Virginia Statute of Limitations

DePuy Hip Implant Failures

The two hip implant systems that were named in the DePuy recall are:

  • ASR™ XL Acetabular System
  • ASR™ Hip Resurfacing System

The acetabular system was used for total hip replacements, while the resurfacing system was used to try to retain as much of the original joint as possible. The resurfacing system was not approved for use in the U.S. According to the recall, approximately 12 to 13 percent of the systems would fail in as few as five years.

But, according to The British Orthopedic Association and the British Hip Society, the failure rate of the ASR™ XL Acetabular System is much higher than what DePuy claims. The British orthopedists' group said that its data indicates that 21 percent of the implants will fail after 4 years and 49 percent after 6 years.

When an implant fails, the patient will need to undergo a second surgery known as a revision surgery. Revision surgeries are often more difficult for the surgeon and more painful for the patient. This is due to the original failed implant causing damage to surrounding tissues and structures.
