What is the Wyoming Statute of Limitations?

Each state has what is called the statute of limitations. This sets the guidelines for the maximum amount of time an injured person can wait before filing a lawsuit. No actions can be taken against the at-fault party once the statute of limitations has expired. The time limit begins to expire either when the injury occurs (occurrence rule) or from the time the injury is discovered (discovery rule).

The Wyoming statute of limitations are:

  • Personal Injury - 4 years, with the discovery rule
  • Wrongful Death - 2 years, from the date of death
  • Products Liability - 4 years, with the discovery rule

DePuy Hip Implant Failures

The recalled hip implants are failing much faster than they should. Artificial hips are expected to last 15 years, but some DePuy hips are failing in as few as 5. The early failure have resulted in the recall of two systems, the ASR™ XL Acetabular System (sold worldwide) and the ASR™ Hip Resurfacing System (sold only outside the U.S.

According to the recall, the failure rate for these two products is between 12-13 percent during the first 5 years. A normally functioning implant should last at least 15 years. When these implants fail they require a revision surgery, which is often more difficult to perform and recover from than the initial surgery.

The implants are failing because they can become loose due to a design flaw. Symptoms of a loose implant include the following:

  • Pain in the groin, hip, and lower back
  • Swelling
  • Difficulty walking and standing
  • Popping or clicking sounds when walking
  • A feeling that the hip is out of place
